1. Acceptance of Terms

By accessing or using DeerSell ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Eligibility & User Responsibilities

To use DeerSell, you must:

• Be at least 18 years of age
• Comply with all federal, state, and local laws regarding exotic animal ownership and trade
• Hold all necessary permits and licenses required in your jurisdiction
• Provide accurate and truthful information in your profile and listings

You are solely responsible for your listings, messages, and compliance with applicable laws and regulations.This includes but is not limited to the Endangered Species Act (ESA), CITES, state exotic animal laws, and USDA Animal Welfare Act requirements.

3. Prohibited Conduct

Users may not:

• List or sell illegal species or animals obtained illegally
• Misrepresent animal health, age, genetics, or other characteristics
• Use the platform for fraudulent purposes or to harass other users
• Attempt to circumvent platform fees by conducting transactions off-platform
• Scrape, copy, or use automated tools to access platform data

4. Payments & Premium Features

Subscriptions and transactions may be processed by third parties (e.g., Stripe). Additional terms may apply. Payment processing is handled securely through Stripe. Premium features (featured listings, subscriptions) are charged according to our pricing page.

DeerSell is a marketplace platform that connects buyers and sellers. We are not a party to transactions between users. All sales are final between buyer and seller unless otherwise agreed.

5. Listing Content & Rights

By posting a listing, you grant DeerSell a non-exclusive, worldwide license to use, display, and distribute your content on our platform and in marketing materials. You retain ownership of your content and are responsible for ensuring you have rights to all photos and information posted.

6. Disclaimer & Liability

Service is provided "as is" without warranties. We are not liable for losses arising from use of the service. THE PLATFORM IS PROVIDED WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• The accuracy of listings or user information
• The legality of transactions or compliance with permits
• The quality, health, or genetics of animals
• Uninterrupted or error-free service

DeerSell does not verify permits or legal compliance. It is your responsibility to ensure all transactions are legal in your jurisdiction.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEERSELL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTIONS BETWEEN USERS.

7. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in prohibited conduct. Users may delete their accounts at any time through account settings.

8. Changes to Terms

We may update these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. Material changes will be announced via email or platform notification.

9. Governing Law

These terms are governed by the laws of the State of Texas, United States.
